Welcome to Elitesuites+ (“Elitesuites+”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, AI-powered platform, mobile applications, and all related services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Introduction and Acceptance of Terms

Elitesuites+ is a software-as-a-service platform that provides AI-assisted tools for resume/CV creation, optimization, cover letter generation, resume editing, job matching, and career development services. These Terms constitute a legally binding agreement between you and Elitesuites+.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

2. User Accounts and Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this age requirement.

3. Services Provided

Our Services include AI-powered tools to help you build, edit, and optimize resumes and cover letters, generate professional documents, and receive job matching recommendations based on your profile and preferences.

All content generated by our AI is provided “as is” for your personal use. While we strive for high quality, we do not guarantee that AI-generated documents will result in job offers or interviews.

4. User Responsibilities and Content

You are solely responsible for the accuracy, legality, and content of all materials you upload or create using our Services (including resumes, cover letters, and personal information). You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and process your content solely to provide and improve the Services, including training our AI models.

You agree not to upload content that is false, misleading, infringing, defamatory, or violates any third-party rights.

5. Prohibited Conduct and Fraud Prevention

You agree not to:

  • Use the Services for any illegal, fraudulent, or unauthorized purpose.
  • Create fake accounts, impersonate others, or engage in deceptive practices.
  • Attempt to reverse engineer, hack, or interfere with the Services.
  • Upload viruses, malware, or harmful code.
  • Use the Services to generate misleading or false employment documents intended to deceive employers.

Fraud Policy: Any fraudulent activity, including but not limited to payment fraud, identity theft, or misuse of the platform, will result in immediate account termination, forfeiture of all payments, and potential legal action. We cooperate fully with law enforcement authorities in cases of suspected fraud.

6. Payments and Billing

All payments are processed securely through our third-party payment provider, Paystack. We do not store your full payment card details.

Subscription plans and one-time purchases are billed as described on our pricing page. Subscriptions automatically renew unless cancelled. You are responsible for all charges incurred under your account.

Prices are subject to change with notice. All payments are non-refundable except as explicitly stated in our Refund Policy below.

7. Refund Policy

Due to the digital and AI-generated nature of our Services, all sales are final and non-refundable unless otherwise required by law.

Exceptions:

  • If you experience a technical failure preventing access to paid features for more than 48 hours after contacting support, we may, at our discretion, offer a partial refund or service credit.
  • Refunds will not be issued for dissatisfaction with AI-generated content quality, as results vary based on user input.
  • Any approved refund will be processed within 14 business days via the original payment method.

To request a refund, contact support within 7 days of purchase with your transaction reference.

8. Intellectual Property

All content, technology, AI models, and materials on the Services are owned by or licensed to Elitesuites+. You are granted a limited, revocable, non-transferable license to use the Services for personal, non-commercial career purposes only.

You retain ownership of the documents you create, but you grant us rights to use them for AI training and service improvement.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Services ceases immediately, but certain provisions (liability, IP, governing law) survive.

10. Partnerships and Affiliates

We may enter into partnership agreements with job boards, employers, educational institutions, or other entities to enhance our job matching capabilities. By using the Services, you consent to your anonymized profile data being used in such partnerships for matching purposes.

Partnership Terms: Partners are bound by separate agreements. Users are not considered partners unless they enter into a specific written partnership contract with us. Unauthorized use of our branding or representation as an affiliate is strictly prohibited.

11. Disclaimers and Limitation of Liability

The Services are provided “as is” without warranties of any kind. We do not guarantee job placement, interview success, or accuracy of AI outputs. We are not liable for any employment-related outcomes.

To the maximum extent permitted by law, Elitesuites+ shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved exclusively in the courts of Kisumu, Kenya.

13. Miscellaneous

If any provision of these Terms is found invalid, the remaining provisions remain in full force. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and Elitesuites+ regarding the Services.
